"The EU approach to SEPs - HUAWEI, its aftermath and potential developments"



Already in 2015, the Court of Justice of the European Union ruled in its landmark decision HUAWEI v ZTE that in case of Standard Essential Patents (SEPs), injunction claims by the patent holder may be barred under certain conditions. It was left to national courts and competition authorities to interpret and apply these conditions. After an intensive debate, the European Commission published on 29 November 2017 its Communication entitled "Setting out the EU Approach to Standard Essential Patents" (COM 2017(712) final) in order to address some of the uncertainties in SEP licesing left unresolved following the CJEU´s decision, and to drive progress for the EU-wide adoption of 5G.

In our seminar, experts from academia, the judiciary, industry and private practice will look at HUAWEI v ZTE and its aftermath in Europe, with a special focus on its effects before national courts in Germany and the UK. Furthermore, the Seminar will try to look into the future to identify potential challenges, changes and developments.
